Chapter 7 Personal Bankruptcy

In Chapter 13 personal bankruptcy, you are utilizing the bankruptcy process to amend defaults (past due amounts) and catch up with payments over time (over 3-5 years). Chapter 13 can also be used to deal with past due tax debts when the IRS, Pennsylvania Department of Revenue or New Jersey State Department of Taxation will not give you a workable payment plan. In Chapter 11 personal bankruptcy you are not subject to the time limits of a chapter 13 case that is limited to a maximum of 5 years (60 months). No. Under Chapter 7, you can claim exemptions that may protect your home, car, and other personal property. Under Chapter 13, you can also keep your property and make new arrangements for payment with your creditors. You are required to honor your plan payments in order to retain bankruptcy law protection.

Child support, alimony, most taxes, and student loan obligations may not be discharged in bankruptcy.

The ability to file for bankruptcy is not dependent on employment status, and often, losing a job can prompt the decision to file. You may qualify for a particular type of bankruptcy relief based on your reduction in income, and there is no minimum amount of debt necessary to file, provided you are at least 18 years old.
