Chapter 7 Personal Bankruptcy

Chapter 13 Personal Bankruptcy

In Chapter 13 personal bankruptcy, you are utilizing the bankruptcy process to amend defaults (past due amounts) and catch up with payments over time (over 3-5 years). For example, if your home is in foreclosure, we can help you save your home through a Chapter 13 repayment plan that will allow you to catch up over time (as long as 60 months). Similarly, if you are behind on rent and your landlord will not work with you to give you a reasonable repayment plan, we can help you build a plan to catch up on rent in a Chapter 13 bankruptcy case. Chapter 13 can also be used to deal with past due tax debts when the IRS, Pennsylvania Department of Revenue or New Jersey State Department of Taxation will not give you a workable payment plan. We have helped our clients save their homes, save their cars, deal with tax debts, and other debt problems over time. Unlike debt-settlements, which creditors do not have to accept, Chapter 13 bankruptcy is binding on creditors as long as your Chapter 13 plan satisfies the requirements of the bankruptcy code and is confirmed by the Bankruptcy Court.

Chapter 11 Personal Bankruptcy

In Chapter 11 personal bankruptcy you are not subject to the time limits of a chapter 13 case that is limited to a maximum of 5 years (60 months). Also, unlike in Chapter 13 bankruptcy, in Chapter 11 bankruptcy, there are no limits on the total amount of permissible debts. No. Under Chapter 7, you can claim exemptions that may protect your home, car, and other personal property. Under Chapter 13, you can also keep your property and make new arrangements for payment with your creditors. You are required to honor your plan payments in order to retain bankruptcy law protection.

Child support, alimony, most taxes, and student loan obligations may not be discharged in bankruptcy.

The ability to file for bankruptcy is not dependent on employment status, and often, losing a job can prompt the decision to file. You may qualify for a particular type of bankruptcy relief based on your reduction in income, and there is no minimum amount of debt necessary to file, provided you are at least 18 years old. Taking this proactive measure will protect your future employment income from the threat of garnishment once you go back to work.

While a bankruptcy filing is on the public record, filings typically only appear in legal publications, and on certain websites. Federal bankruptcy laws protect employees from discrimination in employment decisions based on bankruptcy, with some exceptions for those with security clearances or are bonded.
